Kristen L. (Schaub) Testa concentrates her law practice on estates, trusts, and probate work. Through her Surrogate's Court work, Kristen Testa has represented complex estates involving children, the mentally disabled, spousal right of election and opposing siblings. She also has extensive experience with etstates having missing heirs, foreign beneficiaries, charitable remainders, and Medicaid liens. Ms. Testa has completed multiple estates which required a Federal Estate Tax Return (Form 706) for those with assets over the federal taxable threshold, currently at $12.06 million. She takes great pride in helping families navigate through the probate process, which can be a difficult process when someone is grieving the loss of their loved one.
Ms. Testa counsels clients on their unique estate planning needs. She is well versed in drafting custom Last Will and Testaments. This includes testamentary trusts for minor children or individuals with special needs, business succession planning, and considerations for stepchildren. Kristen prepares Health Care Proxies/Living Wills and Power of Attorneys. The 2021 revisions to the Power of Attorney statutory form and our firm’s modifications are essential for those entering skilled nursing facilities. Ms. Testa often travels to client’s homes, the hospital, or care facilities for those who are unable to meet in the office. Ms. Testa routinely prepares Life Estate Deeds and associated tax documents. Life Estate Deeds are a great financial planning tool for families. She is always eager to discuss various estate plans with clients.
Kristen Testa also is experienced in small business matters; successfully resolving OSHA complaints, EEOC / NYS Division of Human Rights complaints, and denials of unemployment. Ms. Testa is skilled in drafting sale contracts, non-disclosure and non-compete agreements, commercial lease contracts, and other agreements small businesses need tailored for successful operation.
Ms. Testa started with Nesper, Ferber & DiGiacomo as a law clerk, during her third year as a student. She rose from associate attorney to partner of the firm. She is a member of the New York State Bar Association and the Bar Association of Erie County. She is also a member of the Woman’s Bar Association of the State of New York – Western New York Chapter and is on the Working Parents Committee. Kristen is also a Certified Mediator by the Child & Family Services Center for Resolution & Justice.
